    There are two places called Asgarby in Lincolnshire
    Asgarby is both a parish and small village in the Wold hills, about 5 miles due west of Spilsby.
    Asgarby is both a parish and small village about 3 miles east of Sleaford. Kelly's 1900 directory lists a Edward Featherstone living in this Asgarby.

    I tried a census search of 1861 to try and eliminate the other males in his second marriage index entry- first one was a widower so that put a spoke in that.

    There are no deaths searching for a William death between 1851-1859 in LEI- trouble is it could be anywhere- I suppose he could have emigrated. I wonder why she adopted the Casswell name, seems rather strange if he committed bigamy

    Hi l finally found the report on the bigamy here goes:

    Leicester journal 19th March 1852:
    On Tuesday 16th William Caswell Featherstone 29 was charged with having on the 3rd of August last at Loughborough married one Ann Cross his former wife Martha being still alive. Mr Joywell conducted the prosecution and Mr Cockle defended the prisoner Thomas Andrew joiner of Long Buckby said that on 13th September 1849 the prisoner had married his daughter at the parish church of Long Buckby. the same witness produced a certificate of their marriage which was found to be correct by the parish book. Andrew Falker maltster of Long Buckby deposed that he was a witness of the above marriage ~ Samuel Lee registrar of births and deaths said he was a witness to his marriage to Ann Cross at Loughborough Baptist chapel on 3rd of August 1850 and saw both parties sign the entry. His lordship introduced the jury to find the prisoner guilty there being no doubt he had contracted two marriages. Mr Cockle having raised an objection as to whether the Baptist chapel where the second marriage was celebrated was properly registered for the purpose , his lordship respited the prisoner to the next assizes to receive his sentence so that it might be ascertained in the meantime in the London Gazette whether the chapel had been properly registered or not.

    Wednesday 17th
    Before the Rt Honourable St John Jervis Knight William Caswell Featherstone was charged with marrying Ann Cross his former wife being still alive and sentence deferred until the next assizes , was this morning brought up and Mr Cockle his counsel not thinking it advisable to take the opinion of the judges on the point he raised yesterday. Prisoner was sentenced to three months hard labour.

    Do you mean the first or "second" wife?
    As only the second marriage is declared void, before 1857 the first wife there would have had to institute annulment proceedings in Parliament, after 1857 a bigamy conviction was accepted as proof of adultery for a civil divorce but this was not an automatic process.
    the "second" wife would be free to remarry once the bigamy case had been proven and would declare herself to be a spinster. Pete

    I think Martha may have married David Smith Bigamously! funny thing is there is also another marriage near by some years later of Martha to a David without her having the Caswell I always wondered did she marry him legally after she knew William was dead this of course may only be my over active imagination! lol I did hear from a long Buckby historian once who told me Marthas child was illegitimate according to her baptism which indicates William didn't go back to her after his sentence but the child would take his name. I don't know a lot about William Caswell other than this, as he's not really mine, by the way Rofold gate would be pinfold gate on the census. I don't know a lot about Ann Cross either as I say neither are my connection but they have both bugged me for years and Ive been trying to help a distant relative. I think Anns father was Francis and they are in Loughborough 1851. the child William and Ann had was brought up by an Uncle an ended up living in London when the family became quite prosperous.
